Hourly Rate/ Retainer

There is one question everyone has in the back of their mind as they are seeking out the right attorney for their case:  What does it cost?  

As a private attorney, Mr. Sahagian has an hourly rate of $325.00.  What is included in his hourly rate? A full time paralegal; attentive legal care; the cost of postage, copies, etc.; a private office space for meetings, depositions, mediation, arbitration; and the dedicated work of a single attorney - no passing your case off to a Junior Associate once you have retained Mr. Sahagian.  The attorney you meet is the only attorney who will work on your case  All of those "extras" are built into his hourly rate, so you won't get a surprise billing for any of the above, as you may find yourself receiving from other law offices.

As you search around for attorneys you will find the word "retainer" coming up, and you begin to find yourself asking:  What is a retainer?

A retainer is a nice way of saying that you pay for a certain amount of an attorney's time up front in order for them to take the case.  This is called having an attorney "formally retained."  With this law practice, a typical retainer for a basic case starts between 10 and 20 hours of Mr. Sahagian's time.  If the case has complicating factors, or if you are charged with a major crime, then the retainer goes up from there.  In the alternative, some cases only need minor representation and Mr. Sahagian can be retained for less than 10 hours.  This is all decided on a case by case basis, and Mr. Sahagian is happy to ballpark your retainer for you over the phone.

What about a fixed rate?  There are a handful of case types which are done in this office at a fixed rate.  They are as follows:

  • Step-parent adoptions of one or more children. 
    • $5,500.00 flat rate. $1,000.00 for each additional child. Flat rate includes all filing fees, birth record fees, DHS fees, FBI/State of Oregon background check fees, etc.
Chapter 7 Bankruptcy
  • Initial filing, representation at the 341 Meeting of Creditors, and continued representation until the Order of Discharge is granted. We also defend against adversary proceedings.
    • $2,200.00 flat rate. Flat rate includes all filings fees, debtor education classes, and credit report if needed.
  • Defense of DUII including representation at the DMV Hearing contesting the validity of the 90 day license suspension, set up of Diversion Program if eligible, and assistance setting up a hardship license if eligible.
    • $3,250.00 (10 hour retainer). This includes all filing fees, discovery request fees, etc. This flat rate does NOT include any Court fines. 
    • PLEASE NOTE:  If you choose to take your case to trial, this flat rate does NOT apply.
  • Expungement of criminal record, arrest record, or both, for eligible persons.
    • $1,305.00 plus the cost for client to obtain original fingerprint card. This flat fee includes all Court filing fees, Oregon State Police background check fees, attorney time, etc. 
    • In the event the DA objects to your Expungement, Mr. Sahagian will appear in Court to defend your Expungement at no additional cost.
Personal Injury
  • Auto Accidents
    • All auto accident cases are taken on a Contingency Fee Basis as follows:
      • 25% on a straight settlement
      • 33.3% if a lawsuit is filed
      • 40% if the case goes to trial
    • Client is required to pay all Court costs, medical record copy charges, etc. out of pocket - those fees are not advanced by the attorney for Contingency Fee cases.

  • Trusts
    • $2,500.00 to $3,500.00 based on complexity of estate.   
    • This fee includes a Pourover Will; any Deeds needed to place real property into the name of the Trust; and any of the following documents you would like to complete your estate: 
      • General Power of Attorney
      • Medical Power of Attorney
      • Durable Power of Attorney
      • Advance Directive/Directive to Physicians/Living Will
  • Amendments to Trusts
    • $250.00/Amendment 
  • General Power of Attorney
    • $75.00 ($50.00 with a Will)
  • Medical Power of Attorney
    • $75.00 ($50.00 with a Will)
  • Durable Power of Attorney
    • $75.00 ($50.00 with a Will)
  • Advance Directive/Directive to Physicians/Living Will
    • $200.00 ($75.00 with a Will)
